What types of businesses are impacted by this ordinance?

The smoke-free ordinance applies to all enclosed public places ofemployment within the City. The ordinance does not apply to designated hotel/motel rooms, most outdoor spaces, private residences or retail tobacco stores.

How will the smoking ban be enforced?

Businesses have the primary responsibility for ensuring customers in their establishments comply with the smoke-free ordinance. Businesses can request that a violator (smoker) stop smoking immediately. Businesses also can stop serving the individual or require that he/she leave the establishment if they do not stop smoking. Businesses also can call the police if the violator becomes violent, disorderly or refuses to leave.

Also, the Building Codes Officer, or Public Safety Department shall, while an establishment is undergoing otherwise mandated inspections, inspect for compliance with this article.

What should I do if someone is smoking in a bar or restaurant?

You can file a complaint by calling 549-1811. The City of Walterboro will refer the complaint to the appropriate officer who will contact you as soon as possible

What is the penalty for a violation?

A person who smokes in an area where smoking is prohibited shall be guilty of an infraction, punishable by a fine of not less than $10.00 nor more than $25.00.

A person who owns, manages, operates, or otherwise controls a public place or place of employment and who fails to comply with the provisions of this ordinance shall be guilty of an infraction, punishable by a fine of not less than $10.00 nor more than $25.00.

Can I smoke outside a bar or restaurant?

Yes, establishments can allow patrons to smoke in outdoor areas so long as they are more than ten (10) feet from any entry into an enclosed area where smoking is prohibited and it is not an outdoor dinning area.
